How To Get Your Lagos Land Layout Approval

lagos-state (1)One of the land regulations of the Lagos State Government is that owners of plots from 10,000sqm and above when applying for C of O, Governor’s Consent, Community Excision or other Titles of Government, is that they must first of all prepare a layout for the land and get it approved by the Government. The reasons according to the government is to ensure that developments of/on such plots are properly coordinated and conform to the state’s town planning regulations/standards in terms of plots delineation, provision and reservation of roads, drainages and necessary setbacks.

Approvals for land layouts are applied for and gotten at the Ministry of Physical Planning and Urban Development (Development Matters Department, Block15, Room 53) Alausa Secretariat, Ikeja. The application are expected to be accompanied by the following key documents: 12 copies of layout plan, title documents/ proof ownership, tax clearance certificate and clearance letter from New Town Development Agency, Ministry of Transport, Lagos State Environment Protection Agency etc. (see complete list of required documents below). To also accompany the application are: details of Engineering and Survey reports detailing key components of the layout like road, drainage, water treatment, water supply, solid waste management, communication, electricity and beacon sheets.

 The schedule of fees for approval of land layout by the Lagos State Government are divided into four: Processing Fee of N250, 000:00 for either residential or commercial plots, Approval Fees of N300, 000:00 per hectares for residential plots and N500, 000:00 per hectares for commercial plots, Administrative Charge of 10% of approval fees and Neighborhood Improvement Charge of N200, 000:00 per hectare for residential plot and N300, 000:00 per hectare for commercial plots. If there are no encumbrances, approval for a layout are expected to take between one or two months.

REQUIRED DOCUMENTS FOR THE APPLICATION FOR APPROVAL FOR LAND LAYOUT

  • 12 Copies of Layout Plan
  • Two number sun print/cloth of perimeter survey plan
  • Title document/ proof ownership
  • Four copies of technical report written by a town planner
  • Former Approved Layout (If any)
  • Certificate of Incorporation of Company (if applicant is a corporate body)
  • Payee Returns (if applicant is a corporate body)
  • Copy of Development Levy Receipt
  • Tax Clearance Certificate
  • Four copies of Engineering Report and Drawings of Infrastructures
  • Clearance Letter from NTDA, Ministry of Transport and Lagos State Environment Protection Agency
  • Topographical survey plan prepared in accordance to the survey regulation
  • Super-imposition of layout plan on topographical map
  • Sub soil investigation report
  • Boundary Pillars
  • Spot height plan
  • Contour

If you’re building a home to live in, you should set your sights firmly on finding a location that’s:a) comfortable, b) convenient, c) safe, andd) within your budget.  These are the things that most people instinctively want when they choose a location for their home anyway.

However, building solely for investment purposes over the short term is a completely different kettle of fish – and a notoriously dark art. Historical price fluctuations and rental demand in surrounding area, upcoming developments in the vicinity, the suburb ‘prestige’, rate of transformation and the overall state of the local market are just a few of the things that need to be factored in. Honestly, if you’re looking to choose a strategic location for an investment property, you’ll need to consider things far more carefully, and understand how that works so that you can make an informed decision.

 What is a ‘comfortable’ location?

How ‘comfortable’ a location is for you won’t always be easy to define. Convenience and safety are contributing factors, but the kind of lifestyle you prefer is just as important. We’ve all got different tastes – some of us love the tropics, some of us can’t sleep without the dull, constant buzz of traffic noise, and some of us treasure tranquil, quiet environment with standard infrastructure like roads, drainage and play area. No matter the location you choose, buying a home in a well-developed estate from a trusted real estate developer with track records of excellence should give the needed edge.

How to measure ‘convenience’

Even if you stay in an estate with the most fantastic infrastructure, convenience is a big deal when you’re choosing where to buy a home. Think about your own life (and those of the rest of your family if you have one). The sorts of things that make a particular location ‘convenient’ are those that make it easy to get where you need to go easily, and ensure that all the things you want are nearby. When you’re choosing a location, consider:

(1) Where the main breadwinners work, and how long it’ll take them get there via public transport or private car.

(2) Which way traffic generally flows – if it’s far easier to go against traffic in peak hour if you’re able!

(3) What schools you want your kids to go to (if you already have kids or planning to start having them soonest).

(4) Where the rest of your family and friends live (if you like hanging out).

 How to measure ‘safety’

Obviously it’s impossible to objectively measure how safe any given area is – but there are ways to get a ‘feel’ for the character of a neighbourhood without strolling around at midnight – and to figure out what kinds of social issues and general threats exist there. Simply talk to people around and check on-line (using the name of the area as key words in crime related reports when conducting a search). Although, crime statistics are not readily available for many parts of Nigeria, staying in an estate where proper arrangements have been made for security is the easiest solution to the problem of staying safe.

OTHER SAFETY ISSUES TO CONSIDER

Bad guys aren’t the only safety issue you’ll need to consider. When you’re choosing a location or even when it is an estate, you should also take into account the likelihood of:

•flooding, •soil movement, •erosion, •the presence of dangerous chemicals or salt in the soil, •closeness to high tension power cables, •closeness to petroleum pipelines
